Identity and Address of the Data Controller
In strict compliance with Article 16, Section I of the Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP), we inform you that the entity responsible for processing your personal data is Pixelwave, S.A. de C.V. (“PIXELWAVE,” “we”), with its registered address at Mariano Matamoros 404, Colonia Monterrey Centro, Monterrey, CP 64000, Nuevo León.
Personal Data Subject to Processing
As a result of the service contract between PIXELWAVE and the individual with whom you are affiliated, PIXELWAVE will collect and process your personal data, including: (a) identification, (b) contact, (c) professional and/or business background, (d) communication, and (e) biometric data (for identification purposes). This processing will be carried out in accordance with the principles and provisions of the Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP), its regulations, and applicable legislation.
Purposes of Data Processing
PIXELWAVE will process the following personal data: (a) identification, (b) contact, (c) professional and/or business background, (d) communication, and (e) biometric data, for the following purposes:

a. Verify and confirm your identity as an individual with whom PIXELWAVE has or may establish a professional or business relationship.
b. Contact you regarding any matters related to the professional relationship or potential business engagement with PIXELWAVE.
c. Generate documentation related to the professional or business relationship, such as contracts, agreements, receipts, and any other related or similar documents.
d. Ensure compliance with obligations arising from the professional or potential business relationship.
e. Record your information in PIXELWAVE’s IT systems, applications, software, technologies, or other technological tools.
f. Maintain internal control and manage documentation related to the potential business relationship with PIXELWAVE.
Secondary Purposes
The data subject may refuse the processing of their personal data for secondary purposes by sending an email to the contact provided in this document or through the designated technological tool. The personal data processed for secondary purposes include:
a. Image data, which may be used to generate and/or issue documentation and publications for PIXELWAVE’s internal and/or external use.
b. Opinion data, used for surveys, interviews, informational articles, and/or internal statistical purposes, conducted by PIXELWAVE or third parties.
c. Identification, contact, professional and/or business background, communication, video recordings, voice recordings, and image data, used for events, newsletters, invitations, periodicals, digital magazines, official website content, academic, institutional, organizational, cultural, and professional forums, as well as engagement with you and other clients. These may be organized by PIXELWAVE or third parties for internal and/or external use.
Below is the format you should use to deny consent for the use of your personal data for the secondary purposes mentioned above. This form must be sent along with the data subject’s general information to the contact provided in this document or to the email specified in the designated technological tool.
Opt-Out of Secondary Purposes
I hereby declare that I do not consent to the processing of my personal data for the following secondary purposes:

Use of my personal image for generating and/or issuing documentation and publications for PIXELWAVE’s internal and/or external use.

Use of my opinion-related personal data for surveys, interviews, informational articles, and/or internal statistical purposes.

Use of my identification, contact, academic background, video recordings, voice recordings, and image data for the promotion/publication of events, periodicals, digital magazines, newsletters, official website content, academic, institutional, organizational, cultural, and professional forums, as well as client engagement.
These categories of data may be obtained either directly from you or through public and legally authorized sources.
Personal Data Transfers
PIXELWAVE may transfer your Personal Data or Sensitive Personal Data to:
a) Competent authorities.
b) PIXELWAVE’s affiliated or subsidiary companies.
c) Third parties, including individuals or legal entities, private organizations, and participants in PIXELWAVE events.
d) Third parties or service providers with whom PIXELWAVE has entered into an agreement to ensure the confidentiality and security of your Personal Data.
These transfers are carried out to fulfill obligations arising from a potential professional and/or business relationship with you, as well as to manage and comply with relevant legal requirements, in accordance with the exceptions established by the LFPDPPP or other applicable laws.
PIXELWAVE implements appropriate physical, technological, and administrative security measures to protect your Personal and Sensitive Data, which are stored in controlled databases with restricted access.
Means and Procedures to Exercise ARCO Rights
As the owner of your Personal Data, you may exercise your ARCO Rights (Access, Rectification, Cancellation, and/or Opposition) at any time, either personally or through a legal representative.

Alternatively, in accordance with Article 29 of the LFPDPPP, you may submit your ARCO request via email to PIXELWAVE’s Personal Data Protection Department at: avisodeprivacidad@lineadedenuncia.com.
Your request must include:

Your full name and address or another means of communication for receiving a response.

Documents proving your identity or, if applicable, your legal representation.

A clear and precise description of the Personal Data for which you seek to exercise your ARCO rights.

Any other element or document that may help locate your Personal Data.
Options and Means to Revoke Consent and/or Limit the Use or Disclosure of Personal Data
At any time during the processing of your Personal Data, you may choose to limit its use or disclosure. Additionally, you may revoke your consent for the processing of your Personal Data, except in cases where PIXELWAVE is legally required to continue processing it or when consent is not necessary under Articles 10 and 37 of the LFPDPPP.

Procedures and Means for Communicating Changes to the Privacy Notice
If any changes are made to this Privacy Notice, PIXELWAVE will make them publicly available through its official Privacy site, which can be accessed at the following link: https://www.pixel-wave.com.mx/avisos-de-privacidad. This ensures that you, as the data subject, can take the necessary measures to safeguard your rights.
By acknowledging the terms outlined in this Privacy Notice, you, as the data subject, confirm your understanding and acceptance of how your Personal Data and Sensitive Personal Data will be processed. You expressly consent to the processing of your Personal Data in accordance with this document, recognizing that primary purposes are essential for the establishment or continuation of your legal relationship with PIXELWAVE.
