In strict compliance with the provisions of Article 16, Paragraph I, of the Federal Law on the Protection of Personal Data Held by Private Parties (hereinafter, "LFPDPPP"), we inform you that the entity responsible for processing your personal data is Pixelwave, S.A. de C.V. (hereinafter referred to as “PIXELWAVE,” “we,” or “us”), with its registered address at Mariano Matamoros 404, Colonia Monterrey Centro, Municipality of Monterrey, CP 64000, Nuevo León.
Collection and Use of Personal Data Subject to Processing
Pixelwave, S.A. de C.V. is committed to protecting the confidentiality and privacy of the information entrusted to us. As part of this fundamental obligation, PIXELWAVE is committed to properly safeguarding and using personal information or personal data, including: a) Identification data, b) Location data, c) Contact information, d) Employment data, e) Academic data, f) Sensitive personal data (hereinafter referred to as “Personal Data”). This data may be collected through our websites and/or voluntarily provided by visitors to our websites (hereinafter referred to as the “Users” or “you”).
Personal Data Subject to Processing
We collect Personal Data from Users when they choose to provide it— for example, to contact support inboxes or request certain services. By registering and/or submitting Personal Data on our websites, you also agree to the use of this information in accordance with this Privacy Notice.
Your Personal Data will not be used for purposes other than those stated unless we obtain your consent, or unless required or permitted by applicable law and/or regulations. For instance, if you send us an email requesting information about PIXELWAVE, we will use your email address and any other information you provide to respond to your request, in compliance with the principles and terms established by the LFPDPPP, its regulations, and applicable legislation.
Sensitive Personal Data
PIXELWAVE only collects Sensitive Personal Data when individuals voluntarily provide this information or when such data collection is required or permitted by law and/or applicable regulations. Sensitive information includes Personally Identifiable Information (PII) related to: racial or ethnic origin, political opinions, trade union affiliation, religious, philosophical, or similar beliefs, present and future physical or mental health, genetic information, sexual life or criminal background

Purposes of Data Processing
In accordance with Article 16, Section II, of the LFPDPPP, we inform you that, in general, our intention is to collect only the Personal Data voluntarily provided by Users so that we can offer information and/or services to them, including:
a) Inquiries and requests for proposals (RFP) submitted through the designated contact form
b) Participation in blogs through comments
c) Subscription to exclusive PIXELWAVE content
d) Surveys
e) Informational electronic communications based on your interests
f) Providing information about job opportunities
Please review this Privacy Notice to learn more about how we collect, use, share, and protect the Personal Data we obtain. PIXELWAVE generally collects only the Personal Data necessary to fulfill the User’s request. If additional Personal Data is required, you will be notified at the time of collection through the corresponding Privacy Notice.
Automatic Collection of Personal Data
In some cases, PIXELWAVE automatically collects certain types of information when you visit our websites and through emails we may exchange. Automated technologies may include the use of web server logs to collect IP addresses, "cookies," and "web beacons." Collecting this information allows us to better understand and improve the performance, usability, and effectiveness of PIXELWAVE’s websites, as well as measure the effectiveness of our marketing activities.
IP Addresses
An IP address is a number assigned to your computer each time you access the Internet. It allows computers and servers to recognize and communicate with each other. The IP addresses from which visitors appear to originate may be logged for IT security and system diagnostics purposes. This information may also be used in aggregate form to analyze website trends and performance.
Cookies
A "cookie" is a small text file that a website places in your browser's cookie folder, allowing the site to remember who you are. PIXELWAVE only uses cookies in compliance with the LFPDPPP, in accordance with Article 14 of its regulations and other applicable laws.
Cookies alone do not provide us with your email address or any additional information that could personally identify you.
When you visit a PIXELWAVE website, we use cookies to compile aggregated statistics that help us determine which areas of the site Users prefer.
If you later register on a PIXELWAVE website, this information may be linked to a cookie to enhance and personalize your online experience (e.g., greeting you when you return or providing access to your registration information).
You have the option to decide whether to accept cookies. You can set your computer to notify you when you receive a cookie or to reject cookies altogether. However, please note that if you do not accept cookies, you may not be able to fully experience some features of our website.
In other words, if you want to prevent cookies from tracking you while browsing our sites, you can reset your browser to reject all cookies or to notify you when a cookie is being sent.
Web Beacons
A "web beacon" is a small image file embedded in a webpage that can be used to collect certain information from your device, such as your IP address, the time the content was viewed, the type of browser used, and the presence of cookies previously set by the same server. PIXELWAVE uses web beacons strictly in accordance with the LFPDPPP, its regulations, and other applicable laws.
PIXELWAVE or its service providers may use web beacons to track the effectiveness of third-party websites that provide us with recruitment or marketing services, as well as to collect aggregated visitor statistics and manage cookies.
You have the option to disable certain web beacons by rejecting their associated cookies. The web beacon may still register an anonymous visit from your IP address, but cookie-related information will not be recorded.
In some of our newsletters and other communications, we may confirm a recipient’s email address through embedded links within the messages. We collect this information to assess user interest and enhance future user experiences.
Children
PIXELWAVE understands the importance of protecting children's privacy, especially in an online environment. Our websites are not intentionally designed for or directed at children under the age of 13. As a firm, our policy is never to collect or store information about individuals under 13, except as part of a contract to provide professional services.
Mechanisms to Express Refusal for Data Processing
You have several options regarding the use of our websites. In general, you are not required to provide or submit any personal data when visiting our websites. However, PIXELWAVE may require certain personal data for you to receive additional information about our services and events.
Some websites may also request your consent for specific uses of your personal data, and you have the option to decline such uses. If you choose to unsubscribe from a service or communication, you must submit a request to exercise your Access, Rectification, Cancellation, and Opposition (ARCO) rights, as outlined later in this Privacy Notice.
Sharing and Transfer of PII
In compliance with Article 16, Section V of the LFPDPPP, we do not share Personal Data with third parties or affiliates, except when necessary for our legitimate professional and business needs, to fulfill your requests, and/or as required or permitted by law or professional regulations.
Specifically, PIXELWAVE may transfer your Personal Data to: a) Competent authorities; b) PIXELWAVE’s affiliated or subsidiary companies; c) Third parties or service providers with whom PIXELWAVE has entered into a contract to ensure the confidentiality and security of your Personal Data.
This is done to fulfill the various obligations arising from the use of this website, without prejudice to exceptions established by Mexican legislation, including the LFPDPPP and its Regulations, as well as other applicable laws.
In some cases, PIXELWAVE may also share your Personal Data with external companies, service providers, or vendors working on our behalf to help meet your requests. These transfers will be disclosed in the relevant Privacy Notices applicable to each case and processing activity.
Additionally, PIXELWAVE may transfer certain Personal Data across geographical borders to other PIXELWAVE member firms or external companies working with or on behalf of us. PIXELWAVE may also store Personal Data in a jurisdiction different from where you are located. By providing Personal Data on PIXELWAVE’s websites, visitors consent to this cross-border transfer and/or storage of their data.
PIXELWAVE may also disclose Personal Data in connection with the sale, assignment, or other transfer of the business related to the site where the data was collected, in response to government agency requests or other authorities, or as required by applicable laws, court orders, or government regulations. Such disclosures may also be necessary for data privacy or security audits and/or to investigate or respond to complaints or security threats.
PIXELWAVE employs appropriate physical, technological, and administrative procedures to protect your Personal Data, which is stored in controlled databases with restricted access.
Data Security and Integrity
PIXELWAVE has implemented reasonable security policies and procedures to protect Personal Data against damage, loss, alteration, destruction, or unauthorized use, access, or processing. However, despite PIXELWAVE’s best efforts, absolute security against all threats cannot be guaranteed. To the extent possible, access to your Personal Data is restricted to individuals who need to know it. Those who have access to Personal Data are required to maintain its confidentiality. We also make reasonable efforts to retain Personal Data only for as long as necessary to fulfill individual requests or until Users request its deletion.

Please note that PIXELWAVE’s websites may contain links to other sites, including those maintained by other PIXELWAVE member firms, which are not governed by this Privacy Notice but by their own Privacy Notices, which may differ slightly. We encourage you to review the privacy policy and/or Privacy Notice of each website you visit before disclosing any Personal Data.
Means and Procedures to Exercise ARCO Rights
As the owner of your Personal Data, you may exercise your Rights of Access, Rectification, Cancellation, and/or Opposition (ARCO Rights) regarding the processing of your Personal Data at any time, either personally or through your legal representative. Alternatively, in accordance with Article 29 of the LFPDPPP, you may submit your ARCO Rights request via email to PIXELWAVE’s Personal Data Protection Department at: avisodeprivacidad@lineadedenuncia.com.
Your request must include the following:

Your full name and address or another means of communication to receive the response to your request.

Documents proving your identity or, if applicable, your legal representation as the Personal Data owner.

A clear and precise description of the Personal Data you wish to access, rectify, cancel, or oppose.

Any other element or document that facilitates the location of your Personal Data.
Options and Means to Revoke Consent and/or Limit the Use or Disclosure of Personal Data
In accordance with Articles 16, Section III, and 8, last paragraph, of the LFPDPPP, in addition to the previously mentioned mechanisms for disabling certain tools while browsing our websites, you may, at any time during the processing of your PII, express your intention to limit the use or disclosure of your Personal Data. Likewise, you may revoke your consent regarding the processing of your Personal Data, except when its continued processing is required to comply with a legal obligation imposed on PIXELWAVE as the data controller, or when consent is not necessary under Articles 10 and 37 of the LFPDPPP. Procedures and Means through which the Data Controller will Communicate Changes to this Privacy Notice
In compliance with Article 16, Section VI, of the LFPDPPP, if there are any changes to this Privacy Notice, PIXELWAVE in Mexico will make it publicly available through its official Privacy site, which can be found at the following link: https://www.pixel-wave.com.mx/avisos-de-privacidad, so that you, as the data subject, can take the appropriate measures to protect your rights. In such a case, we will indicate the date when the update and/or modification to this Privacy Notice took place.
