In strict compliance with Article 16, Section I, of the Federal Law on Protection of Personal Data Held by Private Parties (hereinafter, "LFPDPPP"), we inform you that the entity responsible for processing your personal data is Pixelwave, S.A. de C.V. (hereinafter, “PIXELWAVE,” “we,” or “us”), with its registered address at Mariano Matamoros 404, Colonia Monterrey Centro, Monterrey, CP 64000, Nuevo León.

Personal Data Subject to Processing

The Personal Data, Sensitive Personal Data, and additional information we collect from you are customized according to each PIXELWAVE client. If you wish to know what specific information is being collected, you may consult the report submission form on the official website of the disclosure campaign.

Personal Data or additional information may also be collected by our operators to strengthen the details of the report you share with us. You always have the right to access your information and exercise other legal rights. Please refer to the corresponding section of this Privacy Notice for further details.

This Privacy Notice applies exclusively to the following means of collecting Personal Data:

Public Websites

​

The internet subdomains of PIXELWAVE.com, lineadedenuncia.com, and client-specific websites with their own domains serve as data collection channels.

• Report Form: The Personal Data and/or Sensitive Personal Data requested through this form are determined by an agreement between PIXELWAVE and its clients through the design of a unique information collection scheme. These data can be reviewed on the corresponding website for each Whistleblowing System.

• PIXELWAVE is not responsible for notifying informants of any changes to this data collection scheme.

• Analytics Cookies: We do not use cookies to collect information about website traffic or to measure the performance of disclosure campaign websites.

Chat and Instant Messaging

If a client has subscribed to any website chat channels or instant messaging services, PIXELWAVE advisors may collect Personal Data and/or Sensitive Personal Data to complete the reports requested by our clients, following the form and protocol specified by each client.

Telephone Service

​

• Toll-free numbers in each country where PIXELWAVE operates, as well as dedicated vanity numbers assigned according to each client's specifications, serve as the Dedicated Telephone Service channel.

• PIXELWAVE advisors may collect Personal Data and/or Sensitive Personal Data to complete the reports requested by our clients, based on the form and protocol specified by each of them.

Voicemail

​

When informants contact PIXELWAVE via telephone, the call may be recorded solely for the purpose of evaluating service quality. Only PIXELWAVE has access to these recordings, and they will not be shared with any third party, including the organizations we serve.

Please note that recordings are automatically deleted 48 hours after they are created.

Email

​

Emails sent to the domains lineadedenuncia.com or client-specific domains associated with each campaign are protected under this Privacy Notice.

Organizations that receive reports through us may use them to conduct relevant investigations, issue internal or external resolutions, compile statistics, and perform other related tasks.

Investigators within the informants' organizations may initiate anonymous conversation threads to provide feedback on cases using our tools, which are designed to protect the confidentiality of the information.

PIXELWAVE shall in no way be responsible for how its clients handle the reports they receive or for any consequences that such actions may have for the informant, the subject of the report, or any other interested and/or involved third party.

PIXELWAVE may transfer your Personal Data or Sensitive Personal Data to: (a) competent authorities; (b) affiliated or subsidiary companies of PIXELWAVE; and (c) third parties or providers of products or services with whom PIXELWAVE has entered into a respective contract to ensure and protect the confidentiality and security of your Personal Data.

This is done to fulfill various obligations arising from the potential professional and/or business relationship established by the legal entity in which you serve as an officer, as well as to manage and comply with the obligations that apply, without prejudice to the exceptions set forth by the LFPDPPP or any other applicable legislation.

PIXELWAVE implements appropriate physical, technological, and administrative procedures and measures to protect your Personal Data and Sensitive Personal Data, which are safeguarded in controlled databases with restricted access.

At any time, as the owner of the Personal Data, you may exercise your Rights of Access, Rectification, Cancellation, and/or Opposition (ARCO Rights) regarding the processing of your Personal Data, either personally or through your legal representative.

Alternatively, in accordance with Article 29 of the LFPDPPP, you may send your ARCO Rights request via email to PIXELWAVE’s Data Protection Department at avisodeprivacidad@lineadedenuncia.com.

 

The request must contain and include the following:

i. Your full name and address or another means to communicate the response to your request.
ii. Documents proving your identity or, if applicable, legal representation as the owner of the Personal Data.
iii. A clear and precise description of the Personal Data for which you seek to exercise any of your ARCO rights.
iv. Any other element or document that facilitates the location of your Personal Data.

At any time during the processing of your Personal Data, you may express your intention to limit its use or disclosure. Additionally, you may revoke your consent regarding the processing of your Personal Data, except in cases where continued processing is required to comply with a legal obligation imposed on PIXELWAVE as the data controller or when consent is not required under Articles 10 and 37 of the LFPDPPP.

In the event of any changes to this Privacy Notice, PIXELWAVE will make them publicly available through its official Privacy website at the following link: https://www.pixel-wave.com.mx/avisos-de-privacidad, so that you, as the Data Subject, may take the necessary measures to safeguard your rights.

By understanding the terms set forth by PIXELWAVE in this Privacy Notice, you, as the Data Subject, acknowledge and digitally validate the conditions under which your Personal Data and Sensitive Personal Data will be processed. Accordingly, you express your consent for the processing of your Personal Data in accordance with this document, understanding that the primary purposes are necessary for the formalization or maintenance of the legal relationship with PIXELWAVE and that you have been given the opportunity to specifically express your consent or refusal regarding the processing of your data for the secondary purposes outlined in this Privacy Notice.

Your acknowledgment of the above is made electronically, as communicated by PIXELWAVE through the platform you use or access, confirming your awareness of the contents of this document.

By accepting, the informant freely, expressly, and knowingly consents to the use of their data for the purposes mentioned above and authorizes their processing, storage, collection, or transfer.
